Evidence
Anchored, self-verifying work.
Everything a lawyer asserts stands on something: a document, a testimony, a precedent, a fact. In most practices, the connections between claim and source live in one lawyer's memory. The MATTER position: the connections are the asset. Every claim in every draft is anchored to its source. The practice becomes self-verifying - and the legitimate fear about AI, fabrication, is answered not by 'better AI' but by a standing rule that no assertion enters work product without an anchor.
Why it matters
This is the primitive where the AI question actually gets decided. An AI drafting inside a strict evidence-anchoring rule is safer than a tired human drafting outside one - because the rule, not the technology, is what makes the work trustworthy.
How to systematise it
- 01Adopt one absolute rule: no factual assertion ships without a source a reader can open in one click.
- 02Apply the rule to humans first - a senior lawyer's 'trust me, it's in the case' fails the same check as an unanchored AI paragraph.
- 03Build a habit of citing to page and paragraph, not just 'the contract' or 'the judgment.'
- 04Treat any unanchored line, human or machine, as a failed preflight check - not a moral failing, just a draft that isn't ready.
What automation looks like, once this is systematised
An agent drafts with citations attached inline as it goes, and a lawyer's review becomes a fast pass over the anchors rather than a slow reconstruction of where each claim came from. Hallucination stops being existentially scary because an unanchored line is now just a normal, catchable draft error.
Common failure modes
- −Citations exist in the final document but the underlying source was never actually checked before drafting.
- −The rule applies informally to AI output but not to senior lawyers' assertions, creating a double standard nobody enforces.
- −"Anchored" means a vague reference to a whole document rather than a specific page and paragraph.
Self-check
- ?Could any reader open every citation in your last major filing in one click and find the exact supporting passage?
- ?If an AI-drafted paragraph turned out to be wrong, would your current process have caught it before it shipped?
- ?Do senior lawyers get held to the same anchoring standard as junior staff and agents?
