Matter
The atomic unit of legal work.
Most practices are organised around something else - the inbox, a person, a folder. The MATTER position is that the matter itself is the container. Every action, deadline, person, document, and note attaches to it. One matter, one place, one state. The test is brutally simple: could a competent stranger open a single matter and understand its complete state in ten minutes, without asking anyone? In a systematised practice, every day, for every matter, the answer is yes.
Why it matters
Every other primitive depends on this one having an owner. Actions belong to matters. Time is measured against matters. Teams are assigned to matters. Evidence is anchored to matters. Get the container wrong and every later system you build sits on sand - you can automate a badly-defined matter, but you'll only automate the confusion faster.
How to systematise it
- 01Write down, in one sentence, what a 'matter' is in your practice - the unit you open, track, close, and bill against.
- 02Pick one canonical place a matter lives (a system, not a folder structure that changes by lawyer).
- 03Define the minimum fields every matter must carry on day one: parties, jurisdiction, opened date, current status, owner.
- 04Retrofit your five most recent closed matters into that container and see what breaks.
What automation looks like, once this is systematised
Once the container is real, an intake agent can open a matter automatically from a signed engagement letter, a status agent can flag matters that haven't moved in the expected window, and any agent working an action always knows exactly which matter it's attached to - no guessing from an email thread.
Common failure modes
- −The matter 'exists' in name only - its real state lives in the handling lawyer's head.
- −Multiple systems each hold a partial picture (email for facts, a spreadsheet for deadlines, a drive for documents), with no single source of truth.
- −A matter is reopened months later and no one - including the original lawyer - can reconstruct its state quickly.
