Mass tort legal support

Bellwether case workup

Selecting bellwethers means knowing what is actually in each candidate file, and that knowledge is expensive to produce at ten thousand dollars a case. At a fixed price per case, you can work up enough candidates to choose on evidence rather than on which file someone happened to read.

What you receive

A structured case file with liability facts, damages, and exposure assembled for trial selection.

  • A structured case profile against your inventory schema, so cases are comparable side by side
  • Exposure history: product, dates, duration, dose or usage as the records support it
  • A medical causation timeline with diagnosis dates, treating providers and page citations
  • Damages summary covering medical spend, wage loss and the documentation supporting each
  • Case strengths and vulnerabilities listed with the record page that creates each
  • A scored profile against your selection criteria, where you give us the criteria

What it costs, and what it replaces

Both figures are published ranges for the same unit of work. Ours is fixed before we start; if our process gets faster, that is our gain and your price does not move.

How the work runs

  1. 01

    Schema alignment

We work to your inventory schema so every workup is comparable. Where no schema exists we propose one, because a set of narrative memos cannot be sorted and a structured set can.

  2. 02

    Exposure reconstruction

Exposure is reconstructed from pharmacy records, purchase history, employment records or whatever the litigation turns on, with each date anchored to its source page.

  3. 03

    Causation timeline

Diagnosis, treatment and progression are laid out chronologically against exposure, so the temporal relationship the case depends on is visible rather than asserted.

  4. 04

    Vulnerability pass

We list what opposing counsel will find: alternative causes, gaps, prior conditions, inconsistent statements. A workup that only lists strengths is not a workup.

What we need from you

  • The claimant file: medical records, pharmacy or purchase history, and intake materials
  • Your inventory schema or selection criteria
  • The exposure definition applicable to this litigation
  • Any court-ordered plaintiff fact sheet already completed

What we check before delivery

  • Every date in the profile traces to a record page reference
  • Alternative causation evidence is recorded even where it weakens the case
  • Profiles are checked for schema completeness before delivery, so no field is silently empty
  • Inconsistencies between the fact sheet and the records are flagged explicitly

When firms send us this

  • Choosing trial picks from an inventory of several hundred claimants
  • Responding to a defence bellwether selection with an evidence-based counter-list
  • Testing whether an inventory is as strong as intake suggested before investing further
  • Preparing plaintiff fact sheets and case-specific discovery at volume

Questions about bellwether case workup

  • Can you work at inventory scale?

Yes. Workups are priced per case, so twenty candidates cost twenty times one, with volume brackets applying above 100 cases. There is no minimum.

  • Do you rank the cases?

We score them against criteria you supply and show the underlying evidence for each score. Which cases to try is your call, and the scoring exists to inform it, not to make it.

  • Do you handle the plaintiff fact sheets too?

Yes, drafted from the records for your review. Inconsistencies between an existing fact sheet and the records are flagged as part of the workup.
