QDRO preparation

A QDRO fails for boring reasons: the wrong model language, a division method the plan does not administer, a survivor benefit nobody addressed. We draft to the specific plan's requirements and prepare the submission, so the order gets approved the first time.

What you receive

A qualified domestic relations order drafted to the plan administrator's model language.

  • A drafted order using the plan administrator's model or approved language
  • Division terms drafted to match the decree exactly, with any ambiguity in the decree flagged
  • Survivor benefit, earnings adjustment and loan treatment addressed explicitly
  • Separate-interest or shared-payment approach selected to what the plan actually administers
  • A pre-approval submission package for the administrator
  • A checklist of the signatures, filings and follow-up the order needs after entry

What it costs, and what it replaces

Both figures are published ranges for the same unit of work. Ours is fixed before we start; if our process gets faster, that is our gain and your price does not move.

How the work runs

  1. 01

    Plan requirements

We identify the plan type and obtain its model language and procedures before drafting. Defined benefit, defined contribution, federal and military plans each have their own rules, and drafting generically is how orders get rejected.

  2. 02

    Decree reconciliation

The division terms in the decree are reconciled against what the plan can actually administer, and any ambiguity or impossibility is flagged to you before it becomes a rejected order or a second motion.

  3. 03

    Drafting

The order is drafted in the administrator's model language with survivor benefits, earnings, loans and the valuation date all addressed explicitly rather than left implied.

  4. 04

    Pre-approval package

We prepare the submission for administrator pre-approval, plus a post-entry checklist, so the sequence of signature, entry, certification and submission is not left to memory.

What we need from you

  • The decree or settlement agreement containing the division terms
  • The plan name, type and the administrator's model order or requirements, if you have them
  • Participant and alternate payee details
  • The valuation date and division method agreed

What we check before delivery

  • The plan's current model language is checked rather than a version held from a previous matter
  • Division terms are compared clause by clause against the decree
  • Survivor benefit and earnings treatment are confirmed present, since their absence is the most common rejection reason
  • Participant identifiers are verified against the plan's required format

When firms send us this

  • Decrees entered months ago with the QDRO still outstanding
  • Plans that have already rejected a previously drafted order
  • Firms that currently refer QDROs out to a specialist at two to four times the cost
  • Multiple plans in one matter requiring separate, consistent orders

Questions about qdro preparation

  • Do you handle federal and military plans?

Yes — FERS, CSRS, TSP and military retirement each have their own regime, and we draft to the applicable one rather than adapting a private-plan template.

  • What if the decree is ambiguous?

We flag it before drafting rather than drafting around it. An ambiguity resolved by assumption is how a QDRO turns into a post-judgment motion.

  • Do you deal with the plan administrator?

We prepare the pre-approval submission package. Correspondence with the administrator goes out under your firm's name, since the representation is yours.
