Trademark clearance screening

Clearance screening is systematic searching and careful reading of what the search returns. We screen the register and the common-law landscape and hand back a memo listing the real conflicts, with the basis for each, for your assessment.

What you receive

A clearance memo on the proposed mark, with conflicting registrations and common-law uses flagged.

  • Federal register screening with identical, phonetic and design-code variations covered
  • Conflicting registrations and pending applications listed with owner, class, status and goods
  • State register and common-law screening, including trade names and active commercial use
  • Domain and social handle availability checked for the proposed mark
  • Similarity analysis inputs: appearance, sound, meaning and relatedness of goods
  • A risk summary organised by conflict, with the specific basis for each concern

What it costs, and what it replaces

Both figures are published ranges for the same unit of work. Ours is fixed before we start; if our process gets faster, that is our gain and your price does not move.

How the work runs

  1. 01

    Search strategy

We build the search strategy first: phonetic equivalents, common misspellings, translations, and design codes where relevant. The strategy is the difference between a search and a lookup.

  2. 02

    Register screening

Federal and state registers are screened across the strategy, and results are filtered to conflicts that are actually relevant to the classes and goods at issue.

  3. 03

    Common-law sweep

Unregistered use is screened — trade names, active commercial use, domains and handles — because the conflict that stops a launch is frequently unregistered.

  4. 04

    Memo and delivery

The memo sets out each conflict with owner, status, goods and the specific reason it matters, organised so the significant conflicts are at the top rather than in date order.

What we need from you

  • The proposed mark and any stylisation or design element
  • The goods and services, with classes if you have determined them
  • The territory of intended use
  • Any variants under consideration, so they can be screened together

What we check before delivery

  • Search strategy is recorded so the screening can be reproduced or extended later
  • Every listed conflict is verified against the current register record, including status
  • Similarity findings state the basis rather than asserting a conclusion
  • Dead and abandoned records are noted as such, with the date, rather than silently excluded

When firms send us this

  • Brand launches needing several candidate marks screened at once
  • Preliminary knock-out screening before commissioning a full search
  • Portfolio expansion into new classes or territories
  • Screening a mark a client has already started using

Questions about trademark clearance screening

  • Is this a registrability opinion?

No. It is a screening memo setting out what exists and why it may matter, prepared for the engaging attorney. Registrability and risk opinions are legal advice and stay with you.

  • Does this replace a full search report?

No. It is a screening step that tells you whether commissioning a full search vendor report is worth it, and frequently kills a candidate before that expense.

  • Can you screen several candidates together?

Yes, and it is the most common instruction. Each mark is priced individually, with the comparison across candidates included.
