Cross-practice legal support

Demand letter first drafts

A demand letter is mostly assembly: the facts as the file supports them, the damages as the documents prove them, and the legal basis stated cleanly. We do the assembly and hand you a complete draft to sharpen, sign and send.

What you receive

A complete first-draft demand letter, facts and figures filled in, ready for attorney review.

  • A complete first-draft letter in your firm's format and voice
  • A fact section drafted from the file with every assertion traceable to a document
  • A damages section with figures tied to the underlying bills, invoices or records
  • The legal basis stated with supporting authority, where you want authority included
  • A specific demand, deadline and response mechanism, per your instructions
  • An exhibit index keyed to the letter's references

What it costs, and what it replaces

Both figures are published ranges for the same unit of work. Ours is fixed before we start; if our process gets faster, that is our gain and your price does not move.

How the work runs

  1. 01

    File review

We read the file and build a fact chronology before drafting a sentence, so the narrative rests on what the documents actually support rather than on a summary of them.

  2. 02

    Damages assembly

Every figure in the letter is traced to its source document and listed in a schedule, so a recipient who challenges a number can be answered with a page reference rather than a recalculation.

  3. 03

    Drafting

The letter is drafted in your template and your register — a carrier demand and a pre-suit letter to opposing counsel are not the same document — with the demand, deadline and response mechanism you specified.

  4. 04

    Review and delivery

A qualified lawyer reviews the draft against the file, and it is delivered as an editable document with the exhibit index and the damages schedule attached.

What we need from you

  • The file: records, bills, correspondence and anything else the letter should rest on
  • Your desired demand figure and deadline, or the basis for computing them
  • Your firm's letter template and preferred tone
  • The recipient and whether the letter is going to a carrier, a party or counsel

What we check before delivery

  • Every factual assertion in the letter is checked against a source document in the file
  • Damages figures are re-added and reconciled against the underlying bills
  • Any assertion the file does not support is flagged to you rather than softened into the draft
  • The letter is checked for statements that would commit you to a position you have not taken

When firms send us this

  • High-volume pre-litigation practices sending demands continuously
  • Collections and subrogation work where the letter is the product
  • Matters where the file is large and the letter has been sitting on a desk for three weeks
  • Firms that want a consistent demand standard across every fee earner

Questions about demand letter first drafts

  • Will it read like our firm wrote it?

That is the intention. Send two or three letters you have sent before and we draft to that voice and template. The draft is yours to edit, and most firms find the editing gets lighter after the first few.

  • Do you decide the demand figure?

No. You set the figure or the basis for computing it, and we assemble the supporting schedule. Valuing a claim is a legal judgment that stays with the engaging attorney.

  • Can you include legal authority?

Yes, where you want it. Say which authorities or which position, and we draft the basis section with citations verified against the source.
